Community plant variety protection

Operating since 1995, the Community Plant Variety Office (CPVO) manages a system for the protection of the intellectual property rights on plant varieties. Plant varieties pose specific problems as regards the industrial property regime. The UPOV convention (International Union for the Protection of New Varieties of Plants) deals with these challenges. The Plant variety protection system of the European Union is based upon the 1991 act of the UPOV convention.
The paper explains – on the basis of the Council Regulation (EC) 2100/94 of 27 July 1994 on Community plant variety rights and its Implementing Rules – key elements of the Community plant variety rights system.
